The category of the person is one of the most disputed in philosophy, psychology, and law, yet it is crucial to the processes that have determined the nature and exercise of ‘freedom’. As such, it is an important question for feminists as well, though it is not always addressed with the passion that is brought to the issue by animal rights philosophers. In my discussion, I will look at notions of personhood and how personhood is constituted by social and legal frameworks. I will also ask whether the notion of personhood may itself become an instrument of oppression, a category for which one must qualify by socially determined criteria.
